- ESaral Coaching Refund Case of Misleading Advertisements Breach of Contract Open
Inaam Shabir filed this complaint against Esaral Ventures Private Limited on Apr 09, 2026
I enrolled in a *-year online IIT-JEE coaching program offered by eSaral on ** April **** by paying ₹**,*** (including GST), with validity until ** May ****.
The primary reasons for choosing this course at such a high fee were the specific assurances made by the institute, particularly the availability of well-known faculty members and the claim that live classes would be limited to a maximum of *** students for better interaction. I opted for this course over other available alternatives, including a significantly lower-priced course (approximately ₹*,***) with comparable facilities, specifically because of these two promised advantages.
The enrollment was made based on representations in their promotional content, where well-known faculty members Prateek (Chemistry), Saransh Gupta (Physics), and N.K. Gupta (Mathematics) were prominently advertised, with clear labeling indicating them as subject-specific faculty (e.g., “eSaral Chemistry Faculty”, “eSaral Physics Faculty”, etc.).
However, after joining, these representations proved to be misleading. Out of the advertised faculty, only Saransh Gupta (Physics) conducted classes, and that too for less than * months. The other advertised teachers, Prateek and N.K. Gupta, did not conduct regular subject teaching at all. They only appeared occasionally in masterclasses for general exam guidance and motivation, which is not equivalent to being dedicated subject faculty as represented in the promotional material.
Instead, regular classes were conducted by different faculty members, namely R.R. Sir (Chemistry), Satyam Sir (Physics), and Amit Sir (Mathematics), who were not part of the original representations made at the time of enrollment.
The institute also explicitly assured that live classes would have a maximum limit of *** students to ensure proper interaction. However, in actual live classes, this claim was clearly violated. I have evidence in the form of screenshots showing *** students in one class and *** students in another, which directly contradicts their stated promise and significantly affects the quality of teaching and interaction.
Initially, I relied on recorded lectures for a certain period after enrollment. Therefore, I was not immediately aware of the actual number of students attending live classes. When I later started attending live sessions, I discovered that the class strength was far beyond the promised limit.
Despite noticing these issues, I continued with the course for some time due to academic continuity concerns and did not raise an immediate objection during the ongoing session. However, the deficiencies persisted and became increasingly evident over time.
During the admission process, I was told that my seat would only be reserved for * days, creating urgency to make immediate payment. However, it was later observed that admissions continued beyond this period, indicating that this representation was misleading.
These facts clearly establish misleading representations and unfair trade practices, as the services provided were materially different from what was promised at the time of enrollment.
Summary of Key Issues:
Promised subject faculty (Prateek, Saransh Gupta, N.K. Gupta) were not provided as advertised
Prateek and N.K. Gupta only appeared in occasional masterclasses for general guidance, not for subject teaching as clearly represented
Only one advertised teacher taught, and that too for less than * months
Unadvertised replacement teachers were assigned without prior disclosure
Promised class size limit of *** students was violated (evidence shows ***–*** students in live classes)
Misleading urgency created during admission regarding limited seat availability
The course was chosen at a significantly higher price specifically for these promised benefits, which were not delivered
Due to these issues, I discontinued using the course on ** December ****.
I formally communicated my decision to discontinue and requested a refund to the concerned representative via WhatsApp. On ** December **** and subsequent follow-ups, I clearly stated that I was leaving the course due to false promises and requested a pro-rata refund. Despite multiple messages, no satisfactory response was provided.
Further, on * January ****, I explicitly informed the representative that I had already discontinued the course and would not be responsible for any activity on my account thereafter. The message was delivered and seen, as indicated by two blue ticks read receipts
This establishes that the opposite party was duly informed of my discontinuation and refund request, yet failed to take appropriate action.
In light of the above, I request a proportionate refund for the unused portion of the course from * January **** onwards, as I have not received the services in the manner that was represented at the time of enrollment.
